项目摘要

2022年度の主要な点は、ブラジル側のアントニオ・カブラウ教授と研究計画の確認を行い、2023年度に行う国際シンポジウムにおける具体的なパネル構成を固めたことである。第一に、消費者法パネルでは、わが国の消費者裁判手続特例法が改正されたことを受け、適法要件や和解手法とともに残された課題について相互に比較検討する。合わせて、個別消費者への対応と集団的な消費者対応に関し、消費者政策の決定についてリーダーシップをとる法務人権省内の消費者当局と検察庁との関係についても調査し、集団的救済政策に関するわが国の消費者庁の役割について提言を行うことになった。第二に、手続法パネルでは、消費者法パネルと共通テーマとする形で、デュアルエンフォースメントに関する検討を追加する可能性が話し合われた。第三に、高齢者法・障害者法パネルでは、わが国における成年後見法制の改正に対して具体的に参考となるような手続的課題を網羅的に取り扱うことになった。第四に、家族法パネルでは、同性婚に関するわが国での将来的な法改正をメインとしつつも、子の福祉（財産開示を含めた養育費回収など）の問題も含めた手続法的検討を行うことになった。本研究課題では、ブラジル検察庁とのコラボレーションにより、高度脆弱性を有する国民の司法アクセスや救済方法に焦点を当てるものであるが、同時に、集団的救済の政策面に目を向けると、法制度のあり方のみならず、法制度の立案や立法後の運営指揮においてリーダーシップをとる国家当局の役割も重要な研究対象であると考えている。
