本研究では、協同組合基本原則をめぐる議論の収集、分析を中心に検討を始めた。ICAによって1995年に改訂された協同組合基本原則で特徴的なのは、協同組合の自律性の強調、コミュニティーへの関与といったその社会性へのいっそうの言及にあると思われる。また、資本について、その一定程度の不分離原則の堅持は、原則採択に際して特に議論された論点であった。これら議論から学んだことは、協同組合が、成員の互助的団体として組織されながら、高い公共性・社会性を追求しているという点である。それは、協同組合間協同をはじめ、社会連帯を本質的に追求する協同組合の特質からきているということができよう。また、不分割資本の存在は、営利団体と対照的な、協同組合の非営利性を示す指標と見ることができる。資本の不分割性は、その不分割資本の社会的・公共的使用を要請しており、この点でも、協同組合の特質と底通している。労働者協同組合法制定のための研究会においても、協同組合の社会性・公共性について、「労働の協同化」「協同労働」といったキーワードをもって論じられ、団体の構成員の利益としてその利潤が分配される営利企業との違いが強調されている。また、「互助」といっても、これまでは構成員間の互助を中心に語られてきたが、構成員の互助を目的とするとされた協同組合において、構成員の利益のみを追求する要素が薄れ、社会連帯やボランティア的扶助、生きがいや働きがい、といった社会性の追求と結びつけられた互助性が脚光をあび、むしろそれこそが、非営利団体の指標として浮かび上がってきていることが明確となった。今後は、本研究において手にした、これら視点を積極的に法理論として提示していきたいが、まずは、民法学において盛んに論じられる、団体の目的の範囲を検討するなかで、非営利概念に見る「社会的・公共的」要素を検討し、発表していく予定でいる。
