本研究では、公共工事執行過程の大まかな構造的特性を探ることを試みた。費用・品質・技術開発の3つの視点から、従来の公共工事における発注者と大手元請企業の行動を、a)目的、b)制約条件、c)手段、d)評価の4項目に分類することを試みた。従来の指名競争入札制度では、ある工法が指定工法となるためには、複数の業者が当該工法を有していなければならない。指定工法制度は発注者のリスクの軽減という「目的」の達成を支援し、さらに発注者の「全知全能性」の確保並びに公平性の確保という二つの「制約条件」を担保するための「手段」として探られた方法であると解釈できる。インハウス技術力の相対的低下も発注者にとって重要な制約条件である。さらに、コンサルタント市場の未成熟も、発注者と元請企業の双方にとって重要な制約条件であった。これらの制約条件を担保するための方法の一つが、日本版パートナリング&VE方式の採用、すなわち発注者・コンサルタント・元請企業の三者による計画設計段階の詳細な比較設計であった。指定工法制度の採用は、工事の公平な配分に寄与したが、一方で受注戦術における技術開発による価格競争の意義を低下させた。このため、元請企業の受注「手段」として、工事情報の早期収集の重要性が高まった。日本版パートナリングすなわち、計画設計段階への参画は、元請企業にとって早期情報収集のための絶好の機会となった。しかし、公共工事では、設計施工分離の原則という「制約条件」が存在するため、元請企業は、計画設計段階での支援実績を受注調整を制するための最有力な手段の一つとして位置づけていった。大手元請企業間の受注調整に関する問題は、コンサルタント業界の成長に伴い解決されていく可能性もあるが、少なくとも現在は、設計施工分離の原則という制度と業態が整合していないことから生じる構造的問題として捉えるべきである。
