项目摘要

2022年度は、アメリカの移民労働者の処遇にかかわり、政策面での動きと制度面での実情についての研究を進めてきた。今年度は、この2つの研究について拓殖大学政治経済研究所の紀要『拓殖大学論集　政治・経済・法律研究』に論文が掲載された。前者に関しては、「子供時代に入国した者に対する（国外追放）措置の延期」（DACA）をトランプ政権が延長するか否かが、非正規滞在移民労働者の将来に大きくかかわっている。トランプ政権は2017年にこのDACAを廃止することを提案したが、共和党内でDACAの代替政策をめぐる対立と、民主党側の強い反対の下で実現しなかったことを考察した。後者については、アメリカのH-2Bという短期就労ビザの下で働く労働者たちの労働環境について考察した。アメリカでは、H-2Bプログラムが高技能職以外の職種を対象とした短期就労ビザ制度として制定されている。このビザの下では、ビザの終了後、もしくは職場を離れて資格を失った場合、労働者たちは本国へ帰国することが義務付けられており、さらにビザ取得時に設定された使用者の下でのみ就労可能となっている。こうした制約から、このプログラムの下で働く労働者の中には、高額なあっせん手数料を請求され借金して工面したり、残業代が未払いとなったり、不衛生な宿舎に対して高額の家賃が請求される事態も見られていることを論じた。また2022年5月の「アメリカ政治経済研究会」において、トランプ政権の移民政策とその下での短期就労ビザの受け入れ状況について報告した。トランプ政権自体は、移民に対して排斥的な姿勢を明確にしているものの、H-2BやH-1Bなどの主要な短期就労ビザの承認数は、新型コロナウイルスのパンデミックが起きる前までは大幅な変動はなく、若干増加していたことを報告した。
