今年度は、昨年の予備調査の成果を基礎に輸送のアンケートによる本調査をおこなった。まず、予備調査の成果にもとづいてアンケートの質問項目の確定作業をおこなった。アンケートでは、交通事故の被害者が、損害賠償をめぐる加害者や保険会社との紛争の過程で、どのような解決のための機関を利用したか、そしてその機関での処理について当事者はどのように評価しているか、また解決された内容に当事者はどの程度満足しているかなどを骨子とし、約五十問の質問をもうけておこなわれた。調査の準備過程で最も問題となったことは、交通事故の被害経験者をどのようにして抽出するかということである。結局、交通事故紛争処理センター、日弁連交通事故相談センター、各保険会社(損保協会を通じて)の協力を得ることができたが、これらの機関でもっている当事者のリストは、プライバシー保護の観点から当然のことながら我々において直接に利用することはできない。そこで、各機関(会社)から、そのリストにもとづいて本研究のためのアンケートに協力していただけるかどうかを往復ハガキで問いあわせていただき、協力するという返事のあった人について、各機関から名簿をいただき、アンケート用紙を送付した。なお調査地域としては、東京、名古屋、広島の三ヶ所をえらんだ。以上のような経過をたどったため、アンケートの回収までに相当の時間を要し、現在のところ、やや先行した名古屋と広島で約四百通のアンケートを回収したにとどまる。最終的な回収数は合計約二千通になる予定である。今後は集ったアンケートにもとづく分析作業が残されている。その分析と併行して進められている比較法的研究の成果も総合し、交通事故の紛争処理のあるべきシステムについて提言することが課題である。
