日仏の制度比較の中から、賃貸住宅における適正な質と価格を確保する法制度のあり方を探るのが本研究の目的であった。まず、フランスについては、公共住宅供給に関する法制度の歴史的検討とともに、賃貸住宅をめぐる今日的諸問題の検討を行なった。とくに後者からは、この間、家賃と住宅賃貸借にかかわる法制度が大きく揺れ動いていることもあり、本研究の課題逐行のために豊富な素材を見出すことができた。フランスの家賃制度は、(1)住宅賃貸借法制における家賃規制と(2)家賃負担に対する公的援助の二本柱からなっているが、(1)を緩めると(2)の過重負担が問題になること、他方、(2)の負担軽減のために(1)を強化すると、民間賃貸住宅の供給に否定的影響を与えること(1982年法の経験)などである。日本については、住宅公団、住宅公社など公的機関によって供給される賃貸住宅の実態に関して聞き取り調査を実施したほか、現在作業が進行中の借地借家法改正問題について本研究の視角からの検討作業を行なった。フランスとの比較では、家賃水準の異常な上昇があるにもかかわらず家賃規制への関心が薄いこと、家賃に占める地価(地代)部分の比重が高いことが特徴的である。公共賃貸住宅の家賃改訂においても、地価上昇が新家賃に跳ねかえる仕組みになっている。したがって、日本では地価への対処が家賃問題対処のためにどうしても必要になる。たとえば、地価を反映する家賃部分についての適正な規制を前提としないで家賃補助を制度化する場合にはフランス以上に公的財政の過重負担の危険があるし、また、日本では地価を顕在化させない住宅供給の要請がフランスの場合以上に要請される。今後、ここで得られた知見をもとに、課題についてのさらなる理論化に努めたい。
