「大坂法」を知る上で不可欠な大坂町奉行所関係文書は全国に分散しているため、平成6年度はその所在と内容を確認する作業から開始した。具体的には現時点において、東京大学・京都大学・九州大学・大阪府立図書館・神宮文庫等で史料調査を行い、所蔵目録を作成すると同時に、重要性が高いと考えられる町奉行所関係文書についてはこれを複写している。今後は、大坂商業大学や江戸博物館等の所蔵史料についても調査の必要がある。本年度は特に出入筋(民事訴訟手続)に関する史料に重点を置いたが、その一つに「大坂堺問答」がある。これは19世紀初頭における大坂町奉行所と堺奉行所の民事訴訟手続を同時に知りうる史料で、法制史研究者の利用頻度も高いものであるが、これまで全文の翻刻はなされていなかった。今回、申請者が編者となり、各写本を校合して定本を作成したが、その成果は『大坂堺問答-19世紀初頭大坂・堺の民事訴訟手続』という表題で、「大阪市史史料」の一つとしてまもなく刊行される運びとなった。また、吟味筋(刑事訴訟手続)についても、大阪市立大学『法学雑誌』に「大坂町奉行所関係文書」と題して翻刻を開始し、既に二度の連載を経た。今後、「大坂要用録」「大坂町中金銀出入之事」「諸御用秘鑑」「大坂雑例抜書」等、比較的利用価値の高い史料の翻刻を準備している。このように史料の充実をはかる一方、「大坂法」の独自性については、各史料「解説」という形で考察を加えつつある。特に出入筋においては、江戸の干渉を受けながらも経済都市大坂はその独自性を保持したが、それが他の地方-例えば京都・奈良や西国・四国・中国-に及ぼした影響については、未だ不明な点が多い。前述の大坂と堺も類似する手続は多いものの全く同一とは言えず、その差異が堺独自のものか、あるいは大坂の古い形態を残したものかは判明していない。史料の刊行とともに継続的に研究を行い、その成果を蓄積していく方法が現時点では最善であり、長期的視野が必要とされよう。
