本年度は、本研究における2つの課題(〔課題1〕日本国憲法25条1項の規範内容の明確化、〔課題2〕課題1の作業を通じて明らかにされた規範内容に適合的な「セーフティーネット」の構想)につき、前年度に引き続いて具体的作業を行った。課題1については、まず、「健康で文化的な最低限度の生活」を憲法解釈として構想する際には、その根底に憲法11条前段における基本的人権の普遍性が組み込まれていなければならないことを確認し、そのうえで内外におけるシティズンシップをめぐる政治理論を参照しつつ、社会へのコミットメント(対国家・公権力、および対他者)と自律の確保をその要素として含む最低生活像の条件抽出を試みた。以上の作業によって構築された生活像に照らし、課題2への取り組みとして、セーフティーネットの要素となる現行の社会保障諸制度について批判的な検討を行った。ここでは、失業者のみならず、高齢者、心身障害者、子どもの最低生活実現制度について、個別的に考察を加えた。そしてこれら諸制度を綜合し、「縫い目の見えない制度間の連携」を目標に制度改革の進むフィンランドの生活保障制度を参照しつつ、(1)セーフティーネットの及ぶ人的属性の広狭と(2)保障を受けられない時間的空自の有無に着目しつつ、セーフティーネットとしての全体評価を試みた。現在、これまでの検討をふまえ、憲法適合的な「最後のセーフティーネット」についての具体的提言をとりまとめている。以上の成果は、単著『「健康で文化的な最低限度の生活」再考』(仮)として早稲田大学出版部より刊行する準備を進めている。

Topic 1:"A Healthy and Cultural Minimum Life": Constitutional Interpretation, Assumption, Foundation, Article 11, Paragraph 1 of the Constitution: Basic Human Universality, Organization, Confirmation, Internal and External Political Theory Reference, Social Policy (For the country, public power, and others) and self-discipline to ensure that the elements of the minimum living conditions are extracted The above work is aimed at constructing a living image. The second task is to select the elements of the existing social protection system. For example, the unemployed, the mentally disabled, the children, the minimum living conditions, the individual investigation, etc. In order to improve the system reform and improve the living security system, we should comprehensively integrate various systems,(1) improve the quality of life and reduce the number of people,(2) improve the quality of life, and (3) improve the quality of life. Now, this is a discussion, the constitution is suitable for the "final" and specific words. The above results are published in the journal "Health, Culture, and Minimum Life"() and are being prepared for publication by Waseda University Press.
