本年度は,主として,以下の3点を機軸とする研究を行った。第1は,昨年度のアメリカにおける刑事事件の取引的処理の実情との比較という観点から,ドイツにおける刑事事件の取引的処理について検討を行ったことである。起訴法定主義のもと,長く刑事事件における取引を拒んできたドイツにおいても,運用において取引的な処理が進み,その流れはもはや後戻りできないところまで来ていること,競争法分野においては,刑罰と類似する過料につき,リニエンシー制度というかたちで,一種の取引的な処理が正面から認められるに至ったことが明らかになった。第2は,平成16年の刑訴法改正によって創設された即決裁判手続に関する研究である。比較的軽微な事件をより簡易な公判手続で処理することを認める本制度は,手続の負担との軽減と結果の予測可能性の高さという点で,検察官,被告人双方にとって利点を有するものであり,被告人が罪を認めるかわりにこの手続を利用するという意味での事件の取引的処理を促す可能性を持ったものである。これに関する研究成果の一部を,雑誌論文として公表した。第3は,航空事故や医療事故といった,原因の究明がときに困難を伴う事故が起きた場合に,刑事責任追及を断念することで,原因究明を行う制度の是非に関する研究である。これは,従来,刑事事件の取引的処理という中で論じられてきた問題の枠を超えるものであるが,社会の安全に対する関心が高まる中で,刑事法学としても避けて通れない問題である。これについては,事故調査と刑事責任の関係を扱った論考を執筆中であり,できるかぎり早期に公表したいと考えている。
