本年度は、関西学院大学災害復興制度研究所により行われた自治体調査をもとに、自治体の被災者支援の実態ならびに課題点を明らかにし、そこから将来の被災者支援法システムの未来像を見いだすことを目的としている。最近、自治体が被災者支援につき従来の制度とは異なる「独自施策」を打ち出してきているので、それを焦点に分析を試みた。まずは、自治体による被災者支援の法的な根拠付けを行った。その後、自治体調査の分析を行ったが、分析過程の中で一つの問題が生じた。それは、自治体調査の回答項目における「独自施策」の意味合いについての用語法を巡る混乱である。そこでまず、「独自施策」とは「上級の行政主体が講じている施策とは異なった施策を講じること」という定義づけをした上で、本当の意味での独自施策とそうでないものとの区別を行った。次いで、都道府県レベルでは被災者生活再建支援法及び災害救助法の問題点を克服すべく多くの独自施策が行われているので、これらの独自施策につきグループ化と類型化を試みた。このような自治体調査の分析から、(1)自治体に対するアンケート項目の見直しが必要である、(2)行政内部において被災者支援策が果たしてどれだけ把握されているのか、といった問題が浮かび上がった。最後に、被災者支援制度のあり方ならびに被災者支援の地域格差の問題について言及した。これからの被災者支援法システムの展望であるが、これまでに述べてきたような自治体による独自施策が、結局のところ、間接的ではあるが国の被災者支援法制に対する「自治体からのボトムアップ的な政策提言」として作用することで、支援法をはじめとする国の被災者支援法制の改正を促していくものと思われる。このように、自治体には被災者支援に関する法政策のメッセンジャーとしての役割が期待されているのである。
