本研究の目的は以下i〜ivの4つであった。i.国外での言語科学の裁判過程への応用状況を詳細に検討することにより、国民の期待に応える司法制度の「専門的知見を要する事件への対応強化」の言語学からの実践として、具体的に応用が可能な法分野、裁判過程や証拠の種類、および分析手法モデルの発展・確立を目指す。ii.日本の裁判過程での言語科学の利用・発展を妨げている要因を特定し、実現可能な解決策を提言する。iii.言語と法は共にシステムであるという観点から、言語学で利用されているシステム分析の諸理論の法システムの分析への応用可能性を追求する。iv.法言語学の研究成果を、法学教育や専門英語教育に還元する方法を模索する。研究成果について、上記i〜ivに照らして述べる。(i)に関しては、複数回にわたる海外調査、学会参加(発表を含む)を含めて調査を行い、法言語学の応用の分野として商標の識別力および稀釈化の分析モデルを開発した。また、同時に全国で行われている法曹三者による模擬裁判における評議における裁判官と裁判員のコミュニケーションを、発話量や論拠などの観点から分析するモデルを開発した。その成果は、堀田(2007等)に発表済みで、関係各所から比較的高い評価を受けている。(ii)に関しては、言語学の研究対象や研究方法と科学性を検証し、ことばに関する証拠の分析・鑑定の手段として言語科学を利用する際に立ちはだかる障害を、Thomas Kuhnのパラダイム論を有標性(markedness)という観点から捉え直したMcCawley(1985)の理論を援用して考察した。研究結果は、堀田(2006a)にて公表済み。(iii)に関しては、現在、単独の成果としての論文こそないが、筆者の裁判員制度研究の骨子となっている部分として、他の研究成果に活かされているものである。(iv)に関しては、堀田(2006b)にて公表済み。
