项目摘要

EC競争法上の行政制裁金は、利得への固執性と加減算の可能性を座標軸としてみれば、賦課対象行為の選択と制裁金額の算定のいずれにおいても利得への固執性が小さく、加重・軽減要因による加減算の可能性が大きい制度であると評価できる。日本においても独禁法の違反抑止力を強化する観点から、不当な取引制限だけでなく、私的独占(支配型および排除型)に対して、課徴金を賦課することができる制度を導入すべきである。その場合、新しい課徴金制度は、EC競争法上の行政制裁金制度を参考にしつつも、大幅な裁量性の問題などについて一定の修正を加える必要がある。新しい課徴金の算定は、違反行為の対象となった商品・サービスの売上額に一定の算定率を乗じた額を基礎額とし、これに一定の要因に基づいて加減算を行うこととすべきである。いずれの国・地域においても金銭的サンクションは、構造指向的レメディや行為指向的レメディに比べて執行が相対的に容易であり、行政当局や裁判所による継続的監視が不要である点に特徴があるが、それ自体としては市場支配力の弊害に対応するものではないことから、課徴金は、構造指向的レメディ、行為指向的レメディと組合せ、相互補完的に用いる必要がある。
