本課題では、デジタル市場における法規制のあり方を競争政策について検討をする。まず、単独行為（私的独占・不公正な取引方法）について、どのようなメカニズムで競争制限をもたらすかに関する理論（セオリーオブハーム）を解明し、それを踏まえて事前規制等の新たな規制方法に関する立法等を検討する。初年度である本年度は、上記行為の重要な行為類型について、セオリーオブハームの検討を行った。第1に、企業結合規制について比較法・経済学を含めた研究によりセオリーオブハームと新たな規制手法のあり方を検討した。その検討を踏まえ、「デジタル市場の特性を踏まえた企業結合規制の検討」を完成させ、校正も終了している。そこでは、事前審査、事後審査、潜在的競争の排除に関するセオリーオブハーム等のあり方を示した。第2に、不公正な取引方法についてのセオリーオブハームについて、優越的地位の濫用を検討した。とりわけ食べログ事件東京地裁判決に注目し、同判決が示す実体法上の要件の解釈等を検討し、基本的に適切とする一方で、行為者に利益を直接には与えないタイプの行為の規制のための理論およびその課題を明らかにした。第3に、企業結合規制について比較法・経済学を含めた研究により明らかにしようとした。この点は、体系書『独占禁止法』（有斐閣）を公刊し、そこにおいて、企業結合規制におけるセオリーオブハームの現状を明らかにするとともに、検討すべき課題を示し、それを参照した研究者・実務家等と意見交換を行った。
