2006年度より引き続き、研究課題である「中国における「知る権利」および情報公開」について、多角的に研究を進めた。日本国内においては、精力的に中国・アジア地域研究、比較法研究に関連する研究会やシンポジウムに参加し、憲法研究者や中国研究者を中心に、積極的に意見交換を図り、有益な資料の提示・提供を受けた。また、2007年8月に約二週間の日程で中国吉林省長春市、上海直轄市、江蘇省蘇州市を、同年12月に約一週間の日程で中国広東省汕頭市をそれぞれ訪問した。それら訪中において、現地の憲法・行政法研究者や立法・行政実務者にインタビューを実施し、さらには、長春市政務中心、蘇州市行政服務中心を訪問する等、地方政府の情報公開政策の実情を調査した。このような研究調査を通じて、1)中国・地方政府の情報公開政策には地方によってその推進に温度差があること、2)情報公開政策をどのように推進するかにあたり、憲法観・人権観をめぐって政府当局と学者との間に認識のズレがあることが明らかとなった。2007年度下半期以降は、研究調査で得られた成果を発信することにつとめた。2007年11月に開催されたアジア法学会研究大会では、「中国の情報公開地方法規-二つのひな形-」と題して、広東省広州市と上海直轄市の情報公開地方法規をそれぞれ比較憲法的視点から分析し、中国における個人と国家の位相の一端を明らかにすることを試みた。同報告については、その後内容を補充して、同題目で一本の小論にまとめている。同小論は、2008年11月刊行予定の『北東アジアにおける法治の現状と課題(仮題)』(成文堂)に掲載予定である。また、2008年4月に刊行された西村幸次郎編著『現代中国法講義(第3版)』においては、中国の人権状況、人権観、人権立法を順次概観した上で、情報公開と不可分一体である言論の自由をめぐる諸問題を検討した。

In the second half of 2007, the results of research and investigation were reported. In November 2007, the Law Society Research Conference held a discussion on the topic of "Local Regulations on Information Disclosure in China-Two Forms of Information Disclosure," which was analyzed from the perspective of comparative constitution between the local regulations on information disclosure in Guangzhou City, Guangdong Province and Shanghai Municipality. The discussion was conducted on the topic of "Local Regulations on Information Disclosure in China" between the individual and the state. With the report, the content of the report is supplemented, and the same topic is discussed. In the same discussion, the November 2008 issue of "The Status Quo and Issues of the Rule of Law in the Northeast"(Chengwen Hall) was published. Published in April 2008, Kojiro Nishimura edited "Lectures on Modern China Law (3rd Edition)" to discuss issues such as the human condition in China, human rights, and human rights legislation, and the indivisibility of information disclosure and freedom of speech.
