本年度も、地方公共団体が公的扶助を負う意味に関する研究を進めた。第1に、公的扶助事務の一部であるケースワーク活動を行政指導論の分析枠組みの中で位置づける試みを行った。その際、むしろ行政指導の分析枠組みを改めて考えて、行政指導を行政指導たらしめるコンテクストの分析を行う必要とその際に多極的な利益構造を考慮する必要を意識すると同時に、ケースワークは敢えて利益構造を単純化させ行政と被保護者の二極関係と考えることに意味があることを認識した。第2に、従来のいわゆる「三位一体改革」や現下の地方分権推進改革などの動きも踏まえながら、公的扶助活動の社会保障全体における位置付けとそれを担当する団体のあり方を検討した。公的扶助が自由な政治社会を成立させるために基礎的な(原始的な)社会保障として必ず用意されねばならないこと、国と地方公共団体の分担については、単純なナショナルミニマム論ではこの問題を制御しきれず、シャウプ勧告に基づく分離型と利益帰属の観点からの分担型との間の整序が必要なこと、その際には一般的な財政法・行政法原理を踏まえなければ制度の透明性を欠く危険が高まることを認識した。第3に、地方公共団体の公的扶助を規律する生活保護法が、住民に対するサービスではなく、住民か否かを問わずサービスを地方公共団体に義務付けることを意識した作りになっていることを踏まえ、地方公共団体の住民であることの要件である住所規定の意義を改めて考える必要があること、これが近時ホームレスの住所の問題を考える基礎を提供すること、この観点から見ると地方公共団体は開放的強制加入団体ともいうべき性格を示し、このことを踏まえて地方公共団体の公的扶助活動を位置付けねばならないことを認識した。以上の結果のうち、第2の成果については、ジュリスト2008年5月1・15日合併号と6月1日号に、第3の成果については月刊地方自治2008年6月号に公表される予定である。第1の成果についても平成20年度中にはある論文集の一編として公表される予定である。
