本研究では、表現の自由と人格権との調整について、ドイツ連邦憲法裁判所の判例法理を中心に、両権利に配慮した調整の枠組みについて検討した。研究を進めるにあたっては、(1)具体的な事柄が両者の調整の際に、どのように作用するのか、(2)表現の自由の対抗法益である人格権がいかなる内容を包含するものか、(3)モデル小説とプライバシーとの調整の際の指標は何か、という観点から検討を加えた。

This study focuses on the freedom of expression and the adjustment of personality, and on the case law of the federal constitutional court, and on the consideration of interest and adjustment of personality. The research progress is as follows: (1) the specific event handle, the adjustment time, the role,(2) the freedom of expression, the resistance law, the personality, the content,(3) the adjustment time index, the middle point, the discussion.
