本研究は、ドイツ連邦憲法裁所における<ゆらぎ>と見られる判例傾向を分析することを主たる目的とした。具体的には、基本法の重要な解釈が問題になっており、かつ国民の注目度も高いにも関わらず、あえて憲法解釈の重要な部分についての判断を回避する判例傾向を、他国と比較しながら研究した。研究の結果、価値多元化社会において憲法裁判所が一定の判断を下すこと自体に大きな価値対立を生むといったような困難さが、このような傾向を引き起こしている原因ではないかという結論に至った。

This study aims to analyze the legal precedent of the United States Constitution. Specific, basic law important solution to the problem, the attention of the people, the important part of the constitutional solution, the judgment, the avoidance of the case tendency, the comparison of other countries The results of the study, the value of the pluralistic society, the determination of the constitutional tribunal, the determination of the difficulties, the tendency to lead to the causes, and the conclusion.
