公共調達における不正発生メカニズムについて、公共工事、防衛調達等分野ごとに制度面、実際面における考察を行い、主として行政法分野における不正防止のための制度構築への示唆を行った。共通する点として、これまで会計法、地方自治法といった会計法令が定めるところと実際の公共調達実務とのかい離がその背景にあることが指摘できた。一般競争と総合評価の組み合わせ一般化されるだろう今後においては、入札談合ではなく入札妨害が多発するだろうと予測でき、従来のような刑事法的対応のみならず入札契約制度見直し(総合評価方式への対応等)、モニタリング(常設の第三者委員会方式、公契約にかかわる独立性の高い内部監査機関設置の義務付け)やビッド・プロテスト(処分性の有無とは切り離して特別の手続を用意)の組織面、手続面での対応等、行政法的対応が必要になるという結論を得た。
