项目摘要

長寿医療の法的課題に関する研究本年度の研究目的は、再生医学・抗加齢医学等長寿科学の各国における規制の現状に関する調査であった。具体的には、各国の再生医学や抗加齢医学に関連する規制を調べると同時に、これらの研究の土台となるヒト由来試料、とりわけバンキングされた試料の取り扱いをめぐる問題を調査した。後者については、昨年度中に研究論文として発表した。その内容は、バンキングされたヒト由来試料の取り扱いをめぐる米国における法廷紛争を分析することを通じて、わが国におけるヒト由来試料を用いての研究を実施する際の倫理的問題、なかでもインフォームド・コンセント上の問題を明らかにするものであった。現在、わが国に限らず多くの国では、連結不可能匿名化することで、ヒト由来試料を用いての研究に対する規制を弱めることを認める場合も多いが、本研究の結果からは、連結不可能匿名化するだけでは対応しきれない問題があることが指摘された。今後、再生医学・抗加齢医学等長寿科学が現在以上発展するためには、ヒト由来試料を用いての研究が不可欠である。実際、わが国の長寿科学研究においてもバンキングされたヒト由来試料は多く利用されている。このような研究は、今後ますますその重要性を増してくることが予想されるが、研究が社会との調和をとりながら発展するためには一定のルールを守り、倫理的に行われる必要がある。本研究においては、再生医学・抗加齢医学等長寿科学の発展に不可欠なヒト由来試料をめぐる法廷闘争を分析することで、わが国の今後の研究進展に不可欠な指摘を与えることができた。

The purpose of this year's research is to investigate the regulatory status of longevity sciences such as regenerative medicine and anti-aging medicine in various countries. Specific research on the regulation of regenerative medicine and anti-additive medicine in various countries is carried out at the same time. The latter is the first time that a research paper has been published in the past year. The contents of the article are: ethical issues during the implementation of the study of the origin of the sample, the selection of the origin of the sample, the analysis of the legal disputes in the United States, and the clarification of the problems in the field. Now, there are many cases where the link cannot be anonymized. The results of this study are not anonymous. In the future, regenerative medicine, anti-aging medicine and other longevity science will be developed in the future. In fact, the scientific research on longevity in China has been carried out in many ways. The importance of research and development in the future will increase. This study is aimed at the development of longevity science, such as regenerative medicine and anti-aging medicine.
