项目摘要

平成22年度は,論文「法定最低賃金の決定構造-日英仏の公的扶助,失業補償,給付つき税額控除制度を含めた比較法的検討-」によって,東京大学より博士(法学)の学位を取得した。同論文は,日英仏の最低賃金制度と公的扶助制度,失業補償制度,給付つき税額控除の歴史的展開と相互関係について分析したものである。この論文によって,研究計画のなかで挙げた2つの目的,すなわち,イギリス労働法の基礎となる考え方を深めることと,最低賃金というテーマそれ自体を深めることの双方が達成された。前者の点は,賃金という労働契約の最重要要素について国家が契約自由の原則を修正するアプローチの検討によった。イギリスでは,賃金決定の論理の枠内で公正さを実現する手段として国家が関わる手続的正当化アプローチをとっていたのに対し,フランスでは国家が積極的に労働者の最低生活保障という内容を実現すべく関わる実体的正当化アプローチをとっていることがわかり,制度の背景にある思想の違いが明らかになった。後者の点については,英仏の制度の接近に着目し,労働市場の変化にともなう最低賃金の再構成の必要性を指摘した。両国では,'非正規労働者の増加を背景に,最低賃金の所得保証的役割の弱まりが意識されている。そのため,最低賃金は,雇用を損なわない限度で低賃金問題を改善する経済政策の一環として位置づけられる。しかしその背景には,労働者のセーフティネットとして,最低賃金のみならず,労働者を対象とする公的扶助や働く貧困層の所得を補完する給付つき税額控除の存在が大きく,それらが不十分な日本とは法的前提が異なる。その動向は,地域別最低賃金を労働者の唯一のセーフティネットとして強化しようとする日本の最低賃金制度の議論とは全く逆方向のものであり,このような日本法の特殊な課題を指摘することができたのは各種社会保障・税制度を研究対象としたことの成果であるといえる。
