项目摘要

本年度は、本研究の最終年度であったが、予定通り課程博士論文を完成させた。具体的には、6月に、平成22年度から『名古屋大学法政論集』に連載されていた「フランスにおける恩赦の法制史的研究」を完結させた。また、同月16日には、法制史学会総会にて、名古屋大学大学院法学研究科で博士論文の提出の要件とされている、公開発表会を行った。その後は、これまでの連載を加筆・修正し、12月に論文を提出した。本研究は、刑法と権力との関係を歴史的に明らかにすることを目的としていたが、この目的を達成するために、刑罰からのアプローチにとどまっていたこれまでの法制史・歴史研究とは全く逆の、「赦し」という視点をとったことに大きな意義があった。研究では、フランスにおける古代から近代、とりわけ絶対王政期から19世紀にかけての時期における、恩赦と権力の関係を、法制・思想・実態の3つの側面から、当時の法令集・法学書や恩赦状、さらに19世紀については統計など、実際に利用・参照された資料に即して考察したが、これにより、従来は「例外的・君主制的・前近代的」なものとして考察の対象外と考えられていた恩赦が、時代を通じて重視されていたこと、また、恩赦は、君主制だけでなく共和制の権力によっても積極的に用いられていたことを、実証的に明らかにすることができた。最後に、本研究の重要性であるが、上述の成果により、これまでの刑罰中心の権力理解に一石を投じることができた点にあると考えている。
