项目摘要

本研究は、人工妊娠中絶(以下、中絶)の早期合法化などの日本の生殖をめぐる特異な歴史的状況のなかで、生殖に関わる技術が養子制度をはじめとする親子をめぐる社会制度にどのような影響をもたらしてきたのかを明らかにするものである。生殖技術と社会制度をめぐる具体的な諸問題にアプローチするため、日本の中絶問題と養子制度の重要な転換点となりえた1973年の菊田医師事件について綿密な考察を試み、それを日本の生殖・福祉をめぐる近代史のなかに位置づけることが目標である。本年度の研究実績の概要は、内容から以下の2点に分けられる。1.菊田医師事件の前史となる第二次大戦前後の胎児・乳児の生命保護にかかわる社会制度と法政策を検討し、「終戦直後の日本における乳児の生命保護――寿産院事件を手がかりに」としてまとめ、第31回日本医学哲学・倫理学会大会で報告を行った。富国強兵政策下の生殖管理体制において堕胎の代替や子の生命保護の仕組みとして機能していた産婆による乳児保護と養子斡旋が、戦後の児童福祉体制の確立と中絶合法化、家族計画政策の実施によって衰退していく過程を明らかにした。2.菊田医師事件が提起した「女性の出産・縁組の記録に関するプライバシーの保護」について、養子法における理論的考察を行い、学外の共同研究会「生殖技術と養子法」で発表した。出産女性が出生児の養子縁組を選択する場合における出生届の受理の方法、戸籍の記載方法、出産・縁組記録の管理の方法等について、今後の養子法の改正で検討されるべき論点を提示した。その他、所属研究科公募研究会と立命館大学生存学研究センターのプロジェクトとの共催で、民法学者の二宮周平氏を講師に招いた公開研究会「生殖と法」を企画し、戸籍制度による出産・縁組記録の管理の問題性や出自を知る権利の問題について討論を行った。
