Comprehensive Research on Regulatory Policies of Non-Standard Employment

本研究首先阐明了欧洲管制法与美国市场功能法在劳动政策上的差异，然后将欧洲的管制分为缔结管制、滥用续约管制和禁止以定期合同为理由的不利待遇三大类，并指出了从缔结管制到滥用续约管制的转变，日本应从中吸取重要的经验教训。自2012年《劳动合同法》修订后，对劳动合同滥用续约的规定进行了新的调整，本研究进一步对有关固定期限劳动的新规定和基本概念进行了解释性讨论。（定期、兼职、派遣工作），研究分析了它们的规定之间的关系，并澄清了所谓“就业形式歧视”的含义。"

This research firstly clarified the contrasting labor policies between European regulatory approach and American market function approach, secondly classified European regulations into three categories (conclusion regulations, abusive renewal regulations, and prohibition of unfavorable treatment by reason of fixed-term contract) and pointed out the shift from conclusion regulations to abusive renewal regulations, from which Japan should learn significant lessons. Since 2012 revision of the Labor Contract Act adopted new regulations focusing on abusive renewal regulations, this research further developed interpretative discussions on new provisions and basic notions concerning the fixed-term employment.As to the three types of non-standard employment (fixed-term, part-time and dispatched work), the research analyzed the relationship of their regulations and clarified the meaning of the so-called "discrimination by reason of employment forms."
