Review on concept of"jurisdiction"in a field of conflict of laws

2011年度，笔者在对传统“管辖权”概念的历史进行研究后，结合美国的讨论以及管辖权与非州法的关系，探讨了该概念在空间上扩展的可能性。在2012年度，笔者以“政权”这一概念的质的扩展为中心，参照广义相对论，对“政权”是否具备司法管辖权的资格进行了分析。通过对这些问题的研究，笔者得出了一个初步的结论：一方面，关于制度法概念的空间扩展的讨论是有意义的，另一方面，关于制度法概念的质的扩展，虽然我们需要发展制度法理论，但它很可能是潜在存在的。

In fiscal year 2011, after researching on the history of traditional “jurisdiction” concept,I examined possibilities of a spatial expansion of the concept with reference to discussion of U.S. and the relationship between jurisdiction and non-state law. In fiscal year 2012, focusing on a qualitative expansion of the concept, I performed an analysis of whether “regime” have qualification as a jurisdiction with referring to the theory of Ge r ma ny. From the research of these, I have arrived at tentative conclusion that the discussion of a spatial expansion of the concept is meaningful, on the other hand, in regard to a qualitative expansion of the concept, while we need to develop the theory of regime law, it is likely that it exists potentially.
