Review on concept of"jurisdiction"in a field of conflict of laws

2011财年，在研究了传统“管辖权”概念的历史之后，我参照美国的讨论以及管辖权与非州法律之间的关系，考察了这一概念在空间上扩展的可能性。在2012财政年度，我着眼于对这一概念的质的扩展，参照GE r r ma Ny的理论，对“制度”是否具有管辖权资格进行了分析。通过对这些问题的研究，笔者初步得出结论：一方面，关于概念的空间扩展的讨论是有意义的，另一方面，对于概念的质的扩展而言，尽管我们需要发展制度法的理论，但它很可能是潜在的存在。

In fiscal year 2011, after researching on the history of traditional “jurisdiction” concept,I examined possibilities of a spatial expansion of the concept with reference to discussion of U.S. and the relationship between jurisdiction and non-state law. In fiscal year 2012, focusing on a qualitative expansion of the concept, I performed an analysis of whether “regime” have qualification as a jurisdiction with referring to the theory of Ge r ma ny. From the research of these, I have arrived at tentative conclusion that the discussion of a spatial expansion of the concept is meaningful, on the other hand, in regard to a qualitative expansion of the concept, while we need to develop the theory of regime law, it is likely that it exists potentially.
