第一に、不確実なリスクの社会への受け入れに関する基礎理論の考察として、フランスにおける被害者の承諾理論の分析を行った。これによって、わが国において明らかにされてこなかった、被害者の承諾の法的性質を明らかにした。すなわち、フランスでは、過失や違法性の評価要素としての承諾と、法律行為の構成要素としての承諾の二側面があるとされている。さらに、被害者の承諾の判断枠組－－成立要件・判断枠組－－が、被侵害法益が財産権である場合と、人格権である場合では異なることを明らかにした。具体的には、フランスでは、財産権侵害について承諾を与えるときには、相手方の信頼が保護される余地があるのに対し、人格権侵害について承諾を与えるときには、人格権の権利主体の意思が尊重されている。その他にも、承諾の撤回の可否や、制限行為能力者による承諾に関する議論おいては、財産権と人格権で法的取扱いに相違があることを明らかにした。そして、これらの研究成果を論文の形で公表した。第二に、不確実なリスクに対する差止請求権の基礎付けを考察するために、フランスにおける差止請求権の理論的展開について分析を行った。ここでは、フランスにおける差止請求権に関する理論的到達点として、フランス民事責任法改正草案に反映された博士号取得論文を詳細に検討した。これによって、わが国における差止請求権の基礎づけに関する示唆を得るとともに、要件論を緻密に構成するための視点を考察している。そして、この研究成果を論文の形で公表した。
