项目摘要

前年度の研究成果をふまえ最終年度は研究をとりまとめるべく引き続き資料調査を進め博士論文を執筆した。その結果得られた研究成果は次のとおりである。昨年度指摘したとおり、家族の呼び寄せ指令及び送還指令は「最低水準」を設定したに過ぎず、加盟国に広範な裁量や多くの例外規定を認めるものである。懸念されるのは、加盟国間の法の統一ではなく分化という事態および権利保護水準の高い国が指令の許容する最低水準へと近づく「底辺への競争」である。両指令が最低水準にとどまった背景には、加盟国間で移民政策の相違が大きいこと、共通移民政策がEUの権限となったのは比較的最近であり、また権限移譲も段階的に行われたことから、EUが盤石な権限基盤のうえで移民政策の高度な共通化が加盟国の利益にもなるように立法することが困難だったことがある。EU委員会および立法権限を有して以降のEU議会は、「廃案よりは最低限の立法を」という方針で交渉に臨んだことも「最低限」の指令制定につながった。指令施行に対するEU裁判所の統制には自ずと限界があり、実際フランスの国内施行に「底辺への競争」の事例がある。共通移民政策が域外国民の権利保障低下と引換なら再考の必要があろう。しかしフランスの国内施行には、指令の許容する「底辺への競争」をこえて、EU裁判所に指令違反とされた国内法を、政府・裁判所がEU法適合的解釈の義務に反して適用し続けた事例も見られた。国内事情がEU法に優先した例であり、EU法化の実際の理解には国内実施の分析が不可欠な典型例である。結論は「EU法化」の実際とはEUから加盟国への一方的な影響ではなく、加盟国のEUへの影響や各国固有の事情に応じたEU法の国内実施の態様を考慮して初めて明らかになるダイナミックな過程だということである。法のグローバル化の考察一般に視座を与えるものであり日本の今後の法の発展を検討するためにも有効である。
