项目摘要

本研究の目的は、アメリカ合衆国におけるJohn Doe litigationについて詳しく検討を重ねるものである。アメリカ合衆国では、被告をJohn Doe（匿名）としてそのまま訴訟提起することが可能であり、例えば、インターネット上の匿名の発信者によって原告が権利侵害を受けた場合、発信者を特定し、損害賠償請求等を行うことができる。John Doe litigationは画期的ではあるものの、連邦法にその根拠がないため、その成り立ちや根拠は判例に委ねられている。本研究では、John Doe litigationの判例研究を通して、その利用場面の実態とJohn Doe litigationの価値及び問題点について整理検討を行い、その全貌を明らかにすることを目標としている。そこで研究開始一年目の2022年度は、West Lawなど法律情報検索データベースを用いて文献検索を行い、John Doe litigationに関する書籍、学術論文を収集し、文献調査を中心に行うこと、John Doe litigationであること自体が紛争の主たる争点になっているアメリカ合衆国の判例を検索を行い、リーディングケースを発見、分析することを目標として研究実施計画に掲げていた。2022年度は、当初の研究計画におおむね従い、John Doe litigationに関する判例に多く触れることができ、リーディングケースになるであろう重要な判例の発見とその分析をおこなった。重要判例にふれて分析するなかで、John Doe litigationに関する学術論文の収集と分析についても計画通り遂行できたように思う。
