项目摘要

①「不当」概念につき、国や地方自治体の審査会答申を参照しつつ、「不当」の判断過程について検討を行った。「不当」判断においては、「解釈基準」及び「裁量基準」の果たしている役割が大きく、行政の専門性が反映されたこれらの基準の「合理性」が判断過程においても一定の影響を及ぼしている。特に、「不当」概念を検討するにあたり着目したのが、「解釈基準」が実務において果たしている役割である。実際の審査会答申を見る限り、「解釈基準」と「裁量基準」の扱いには相違がなく、行政の専門性が尊重されていることがうかがわれた。同様の傾向は裁判例においても指摘することができると思われ、答申例及び裁判例の分析を通して、「解釈基準」の法適合性審査は、「裁量基準」の合理性審査と差異がないことが多いといえる。②また、研究課題に関連するものとして、行政裁量に関して、裁判実務が今日の審査手法にたどり着くまでの戦後の行政裁量論を、学説・実務の双方をフォローしながら明らかにすることを試みた。学説においては、戦後暫くは自由裁量（便宜裁量）と覊束裁量（法規裁量）の区分論に重点が置かれていたと考えられる。そのため、裁量審査の手法については、判例実務先行型であった。学説・実務の双方において、裁量審査の手法に重点が置かれたのは、１９８０年代以降と思われる。１９８０年代以降の学説・実務の「対話」状況を分析しながら、この点を明らかにした。双方の「対話」が活性化した近年においては、学説における審査手法の分析も判例実務に一定の影響を及ぼしている。
