【研究目的】本研究は明治政府成立当初、西欧法の継受が本格的に開始される前後の時期におけるわが国の「裁き」に関する認識あり方を明らかにするとともに、それらが徳川政権から新制度への移行の過渡期において、統治権力機構上いかなる意味を付与されるべきものとして当時の政府において扱われていたかを明らかにすることを目指すものである。これにより、わが国の近代法体制の輪郭形成の一旦としての「民事(訴訟)」・「刑事(訴訟)」の形成を考究するに当たっての確固たる基盤を形成することを目的とする。【研究方法・研究成果】本年度は、国外史料の整理の見通しを得ることが全体の研究目的の達成に有益であるとの判断から、日本にもたらされたオランダをはじめとした西欧法関係文獻、特に海外史料の蒐集・整理に重点を置いた。具体的にはオランダ出張を行い、主にライデン大学図書館とオランダ王立図書館において、日本にもたらされたオランダ法文献に関連する19世紀オランダ国法学についての文献を収集したほか、オランダの18～19世紀における法典編纂やフランス法との影響関係等に関する法学・法制史関連書籍を入手、読解した。帰国後蒐集史料・書籍のリスト化を進める一方で、19世紀初頭から中期にかけて日本で翻訳された数種の「和蘭律書」と当時の『和蘭字彙』をはじめとした蘭語辞書の裁きに関する語彙に着目し、オランダにて収集した法典との対照作業を行った。これにより、同書原典の民事訴訟法典と刑事訴訟法典とが混然とした形で理解されていることを確認した。また同原法典はフランス統治期終了直後のものであり、ここにオランダ法と日本法の受容の関係についての更なる考慮事項として、日本も明治初年から大いに影響を受けることになるフランス法との継受の関係を見通す必要があることが強く指摘されるべきであることを確認した。なお、以上の作業成果の一部は、『法律時報』誌において史料紹介を行うとともにKyushu University Legal Research Bulletin誌に英語論文として投稿し、査読を経て掲載された。

[Purpose] This study covers the period before and after the establishment of the Meiji government and the beginning of the acceptance of Western European law as the basis for the transition of the new system. The governance mechanism is responsible for the implementation of the policy. The formation of the modern legal system of the country and the formation of the "civil (litigation)" and "criminal (litigation)" should be studied and the foundation of the formation of the "purpose" should be established. [Research methods and research results] This year, the collection of foreign historical materials has been beneficial to the achievement of all research objectives. The concrete contents include the collection of legal documents in the 19th century, the influence of codification in the 18th and 19th centuries, and the related books on legal history. The collection of historical materials and the transformation of books have been progressing since the beginning of the 19th century. In the middle of the 19th century, Japan has translated several kinds of "Japanese Law Books" and "Japanese Dictionary" at that time. The Civil Procedure Code and the Criminal Procedure Code are both mixed and understood. In the early years of Meiji in Japan, the influence of the Japanese law on the relationship between the Japanese law and the Japanese law was greatly affected. A part of the above work results is published in the Journal of Legal Times, which introduces historical materials. The Kyushu University Legal Research Bulletin publishes English papers.
