项目摘要

本年度は昨年度の司法省直前期までの検討に引き続き、法務図書館所蔵貴重書中の司法省関連史料等を用いて司法省の設置から司法卿江藤新平の参議転出前後の時期に政府に於いてなされた諸講述を通じたわが国の「司法」の輪郭形成のあり方を問うた。当時の司法省関係者に於いて認識された情報として、第一に御雇い外国人G.ブスケによって司法省の有する権能に即して「裁判の事務(行政の権)」と「裁判を行う権(司法の権)」とが区分されるものとして解説されていることが明らかになった。これは司法卿となった江藤の参照に供され司法省の方針として提示されたが、その際江藤の制度構想の力点は、「裁判を行う権(司法の権)」よりも、これを制度的に下支えする「裁判の事務(行政の権)」に関わる省機構の整備を早急に推進することにあったと考えられる。また第二に裁判以外の役割として司法省の管轄に含まれる諸事務・職制のうち、法典の編纂が広く司法省の権能として理解されたという点は、江藤をはじめとした司法省の官員が西欧法制の単純な模倣というかたちをとらず、一方においてブスケ自身も日本の状況を踏まえてフランス法制に修正を加えつつ講述を行うというそれぞれに柔軟な対応を行っていたものと評価できる。また、こうした講述の受容に際しては、『仏蘭西法律書』や『和蘭司法職制法』などの仏蘭の法制についての翻訳テキストが、裁判所の構成に関する情報などにつき当時の司法省においてブスケの講述の理解の補助線としての役割を担っていたということが確認された。以上の成果をまとめた論文は査読を経て「法政研究」第77巻3号に掲載された(「明治初期における「司法」の展開過程に関する一試論--ブスケ・江藤新平と司法職務定制」)。
