项目摘要

本研究は、地方自治法と地方教育行政の組織及び運営に関する法律（とくに事務処理組織体制を中心に）について、法令・制度上及び運用上の相違点を明らかにし、地方自治制度の視点から教育委員会制度の意義と地方教育行政体制の在り方を再検討することを目的としている。行政サービスのニーズが多様化、複雑化する中で、人口減少地域がいかに充実した教育行政を推進できるのかが課題となっている。研究計画の3年目にあたる2022年度は、前年度の調査を継続して、国の政策動向及び地方自治体の取り組み状況について情報収集を行い、整理した。具体的には、国の地方制度調査会の審議過程及び答申の内容を整理、分析するとともに、教育行政領域に限定した議論として、文部科学省に置かれた「「令和の日本型学校教育」を推進する地方教育行政の充実に向けた調査研究協力者会議」の審議を傍聴し、地方教育行政における課題の整理ならびに制度改革・施策の方向性について確認しながら、論点を整理した。その結果、前年度に得られた知見に加え、①教育委員会事務局内部における職員の資質・能力の向上と、教育行政プロパー職員の採用、外部人材の積極的登用を図る機能強化の動き、②教育委員会外部の積極的役割の検討として、都道府県教育委員会・教育事務所による支援、ならびに自治体内外の資源の有効活用、地方自治法に定める連携協定等の活用等の2つの方向性を視野に検討が進んでいることが確認できた。ただし、後者については、従前から繰り返し提起されてきた内容であり、具体性に乏しい。ここで、特別法としての地方教育行政法の限界が指摘できる。教育行政の理念を踏まえつつ、地方教育行政法の範囲内に留まらない、地方自治法を射程に含めた地方教育行政機構の在り方の検討が求められる。上記の国の政策動向を踏まえつつ、当初予定の研究期間を延長し、次年度に最終的な研究成果をまとめる。
