本年度は、体系書『独占禁止法』（有斐閣、全802頁）を公刊し、そこにおいて、課徴金制度、課徴金減免制度、調査協力減免制度、確約手続等について、わが国における論点について網羅的に検討するとともに、EU、米国と対比しつつ比較法による検討をも行った。同書の第９章（全１10頁）において該当箇所を公表するとともに、第３章、第５章、第６章において関係する論点について公表した。これで本課題に関する大部分の研究成果を公表することができた。優越的地位の濫用のエンフォースメントについて、ラルズ事件東京高裁判決に注目し、同判決の実体法上の論点を検討するとともに、違反行為期間の問題を含む課徴金の算定の問題を検討した。同じく優越的地位の濫用のエンフォースメントに関連して、民事訴訟の役割を検討したものとして、食べログ事件東京地裁判決の判例研究を公表した。そこでは、民事訴訟における優越的地位の濫用規制に役割を示すとともに、デジタルプラットフォームによるアルゴリズムの変更がいかに規制されうるかを、欧州の事例の検討も含めて、行った。また、近時、競争政策としての重要性が高まっているアドボカシーを含めた実態調査、ガイドライン等が果たす、競争法におけるエンフォースメントでの役割を検討する研究成果として、「独占禁止法の業際的発展」を公表した。「電力市場の今後」では、電力市場における制度改革（自由化、市場化）がもたらした新たな競争政策上の課題を検討した。デジタル市場競争会議およびWGに参加し、モバイルOSをめぐる競争法上の規制のあり方を検討する作業に参加するとともに、EUのデジタル市場法（DMA）等を検討しつつ、新しい競争法の規制手法としての「事前規制」の検討に参画した。
