本研究の目的は、わが国の行政訴訟制度の特徴を他の先進各国との比較において位置づけた上で、その形成要因を政治学的に分析することである。従来、わが国の行政訴訟制度は原告適格の要件の厳しさや、出訴期間の短さなどから、他の先進諸国として原告にとって不利であるといわれており、このため他の先進諸国と比べて行政訴訟の件数も少なく、また原告の勝訴率も低いといわれてきた。しかし2000年代前半、一連の司法改革の一環として行政事件訴訟法が改正（2004年）され、原告適格が拡大され、救済範囲が拡大されるとともに、出訴期間も延長され、また2014年には行政不服審査法が改正されるなど、訴訟の提起をしやすくする改正が続いている。行政が自らに対する異議申し立てを制限しようとするのは当然であるが、その制限の仕方や程度には国によって差異がある。わが国の行政訴訟制度はどのような点において、どこまで制限的なのか。そのような制度が成立した政治的な要因は何か。本研究は、これらの問いに対して比較政治学的な分析を行い、仮説を提示しようとするものである。研究3年目の2022年度は、大きく三つの作業を行った。第一に、前年度に引き続き、わが国を含め先進諸国の行政訴訟制度の制度設計やその変化を決定づけた要因を、国際比較の観点から分析する作業を行った。他の先進諸国の行政訴訟制度も見据えつつ、とりわけ台湾と韓国の戦後の行政訴訟制度について文献調査を行った。歴史的な経緯から、戦後当初の両国の制度は、日本の制度と似ている点が多いため、比較分析に格好の事例を提供する。第二に、前年度に引き続き、わが国の不服審査制度について、とりわけ2016年の大改正を中心に分析を行った。第三に、行政訴訟改革の重要性を論じる上では、改革が及ぼした効果についても実証的に検証する必要があるため、前年度に引き続き、判例のデータベースの構築と計量分析を行った。

The purpose of this study is to compare the characteristics of China's administrative litigation system with those of other advanced countries, and to analyze the main causes of its formation.
