本研究は、建築デザインに対する知的財産法全体における意匠法の位置づけを踏まえた、意匠法の下での「建築物の意匠」として保護すべき範囲を明らかにすることを目的として、イギリス法との比較法的見地から、意匠法の下での「建築物」の定義、「建築物の意匠」の類否判断に関する適切な解釈を明らかにするとともに、建築デザインに対する知的財産保護全体における意匠法の役割・意義を明らかにするものである。2022年度は、わが国での建築デザインに対する知的財産保護の現状の整理と問題点の分析を行う予定であった。建築デザインに関わる知的財産保護は、主なものとして、意匠法、著作権法および標識法によるものとが考えられるところ、著作権法の下での「建築の著作物」としての建築デザインの保護に関する裁判例・学説の展開の整理を中心に、国内の文献の収集と分析を行った。もっとも、令和元年意匠法改正により意匠法のもとでも建築デザインが保護されることとなっているため、同改正による保護の拡充の立法経緯と、立法後の審査実務、学説の展開に関する分析や、標識法（立体商標制度及び不競法2条1項1号）による店舗内外装の保護に関する裁判例、審査実務の整理と分析も必要となるものの、新型コロナウイルス感染症の影響等により文献へのアクセスに制約があったため、遅延が生じた。さらにこれに伴い、現状の整理を踏まえた建築デザインに対する知的財産保護の問題点の分析についても、当初の想定よりも遅延することとなった。残された課題については次年度以降の課題としたい。
