项目摘要

研究活動を進める上で、知的財産に関し、研究者は様々な問題に直面している。これまでに、国としての知的財産政策や、組織としての知的財産ポリシーに関する議論が進められてきたが、次の段階としては、研究現場の目線から、知的財産創出の主役である研究者のニーズに則して知的財産をめぐる諸問題の具体的な解決策を考えることが必要である。本研究では、ゲノム分野の研究者が、研究の遂行上、「知的財産」に関してどのような問題を抱えているかに関するアンケート調査を実施した。今回の調査により、ライフサイエンス研究に携わる研究者が、研究成果の技術移転体制、研究活動における特許権使用の円滑化といった課題について、現状でどのように考えているかが明らかになった。特に、他人が特許権を持つ発明を研究において使用する際にあたって、問題が生じていることが明らかになった。現在、日本の特許法69条1項の通説的解釈においては、他者が特許権を持っている発明(特許発明)を研究活動において使用する場合は、特許権の効力が及ぶため、権利者から実施許諾を受ける必要があるが、研究ツールの使用を促進して研究活動を活性化するため、「学術機関での研究(営利機関でない)」「非商業的目的の研究」「基礎研究(応用研究でない)」などの線引きにより、特許権の効力範囲から除外する対象を定めておくべきだという見解がある。アンケートの結果、「学術機関の非商業的目的の研究」は効力範囲外とすべきであり、学術機関であっても商業的目的の研究の場合は効力範囲内とすべし、という答えが過半数以上であった。さらに、研究ツールの使用を円滑化するためのコンソーシアムの設立についても、希望する声が多数あり、今後の制度設計のための貴重な資料となった。
