项目摘要

今日、電気通信事業について、EUでも、またドツでも、一層の規制緩和と競争政策の執行強化という法政策的方向性がいよいよ鮮明になってきた。規制緩和という視点に関わっては、本研究年度において、EUでは、独占的供給の許容されてきた電話サービスについて、また電気通信ネットワークの構築、運用についても、段階的ではあれ自由化の政策ラインが定まってきた。これは、日米との国際競争に打ち勝つため産業競争力を強化してゆく必要があるとのEU委員会の強い危機認識が、その背景にあるものと思われる。かかるEU全体の政策動向を受けて、EU加盟国たるドイツでも、本研究年度において、電気通信規制のあり方が改革された。ドイツの改革では、まず基本法の改正を通じてDBPを民営化すると共に、電話サービスや電気通信ネットワークの構築・運用につき、段階的・裁量的に新規参入を許容する方向が打ち出された。しかし、他方で、なおDBPによる電気通信ネットワークの原則独占が解消し切れていないという問題があり、この点をもって今回の改革では自由化・規制緩和措置として全く不十分であるとの見解も強く、この視点から見るときには、今回の改革の真の重点はDBPの民営化にこそあったとの皮肉な評価も可能であろう。次に、競争政策の強化という視点からは、EUにおいて、ことにEU委員会の実務運用の面からいって、競争政策の執行強化という問題意識が次第に一層重要なポイントとなってきていることがうかがわれる。このことは、各加盟国の動向にも影響を与えており、ドイツでもその種の見解が強調される傾向になりつつあり、またイギリスなどでも、電気通信事業に対する競争法の適用可能性の議論や、BTの市場支配力の濫用に対する行政的規制の一層の拡充という課題が認識され、オフテルもその旨のステートメントを起こして、議論を開始したところである。
