1.本研究の対象たる保険商品の透明性に関しては、保険の引受危険の範囲に関する透明性と、募集手数料その他の販売コスト、金融商品類似の資産価値等の観点における透明性とが問題となり得るが、本年度は専ら前者の研究を行った。2.わが国の家計保険領域では、市場に投入される複数の保険商品の間の顧客による選択に際して商品情報の透明性が問題となる。しかし、この問題につき積極的な情報提供規整は整備されておらず、特別規整である保険募集の取締に関する法律16条1項1号(平成7年保険業法300条1項1号に対応)により保険募集人に課せられた、顧客に対する保険契約上の重要事項の告知義務及び契約法の一般理論により処理しなければならない。わが国の保険募集規制は、従来から指摘のある通り、保険募集人の行き過ぎた募集活動の防止という観点から禁止行為を定めたものである。しかし、先に掲げた法条は、約款取引においては個々の条項の具体的了知の有無は契約成立にも個々の条項の拘束力にも(一部無効の問題を除き)影響を与えないという法的評価を踏まえ、保険取引にあっては重要事項の了知・商品比較を経た上での効果意思形成の確保を目的としたと解すべきである。3.かかる枠組の下では、保険募集人は顧客の多様な保険需要を整理して定型的な保険契約への締結勧誘を委託されたと評価することができ、従って、顧客の保険需要から認識し得る限りで個別事情に応じて顧客の商品選択にとって重要な事項を告知説明することが法的に要請される。かかる要請に応ずるための保険募集人の専門知識に関する情報提供能力への信頼については、原則としてかかる業務を委託した保険会社が責任を負うと解すべきであり、保険募集人自身の責任が問われるのは、通常の取引上の信頼を越えた特別の個人的信頼を基礎とすべきことが、ドイツ法研究から裏付けられた。
