项目摘要

本年度は、持続可能な開発概念の解釈をめぐる乖離の問題を検討するために、国連の持続可能な開発に関する委員会特別作業部会による「持続可能な開発に関する国際環境法原則」についての報告書、WTOの貿易と環境に関する委員会での検討、および多数国間環境条約内部での意見の分析などを行った。これらの分析を通じて、持続可能な開発概念の多様性を再認識するとともに、同概念が、予防原則などの新しい法原則の導入に重要な役割を果たしてきた一方で、WTO設置に伴い同概念を積極的に導入した国際貿易レジーム(GATT/WTO体制)と多数国間環境協定では同概念の解釈に大きな乖離が見られることを論証した。また、同概念が環境、開発、人権など、国際社会の普遍的利益と密接に関連することから、国際環境法の諸原則についても重要な影響を与えていることを理解することができた。すなわち、予防原則をはじめとする国際環境法の基本原則も各レジームによって評価が大きく分かれており、この点についてさらに詳細に分析する必要性があることが明らかになった。また、国際法が生み出される構造の特徴として、その時代の超大国の影響力は無視できないが、その観点から、国際環境法に対する米国と欧州のアプローチの違いも浮き彫りになった。これは京都議定書や生物多様性条約に対する批准状況という事実上の問題にとどまらず、持続可能な開発概念に対する解釈及び対応の違いという側面から説明することが可能であると思われる。ただし、同原則の多様性を踏まえて、一次資料の検証を行う必要がある。

This year, the Committee on Trade and Environment of the World Trade Organization (WTO) conducted a review and analysis of views expressed within most international environmental treaties at its Special Operations Committee meeting on "Principles of International Environmental Law Related to Sustainable Development." If this analysis is made clear, it will be possible to re-understand the diversity of development concepts. In addition, the introduction of common concepts, precautionary principles and new legal principles is an important factor. On the one hand, the active introduction of common concepts in the WTO setting, the international trade platform (GATT/WTO system) and most inter-state environmental agreements are far from the interpretation of common concepts. Moreover, it is understandable that the same concept is closely related to the environment, development, human rights, and the general interests of the international community, and that the principles of international environmental law have important implications. The basic principles of international environmental law include the necessity of detailed analysis and evaluation. International environmental law is the basis for the creation of structural characteristics, the influence of the superpowers of the times, and the violation of international environmental law in the United States and Europe. The status of ratification of the Kyoto Protocol and the Convention on Biological Diversity are discussed in detail below.
