本研究課題遂行に当たっての平成18年度の具体的な研究活動は以下の通りである。1.社会福祉協議会による法人後見業務実施に当たっての検討課題の抽出と検討。2.福祉サービスをめぐる苦情・紛争の解決における第三者型専門家ネットワークの構築と展開。3.社会福祉法人職員自身による権利擁護のあり方。1について都道府県社会福祉協議会は、社会福祉法に基づき、地域福祉権利擁護事業(福祉サービス利用援助事業)の実施が義務付けられているところであるが、当該事業利用者が加齢等とともに、当該事業でカバーしうる状態を超え、成年後見制度への移行が必要なケースが出てきている。ところが、成年後見制度が身上看護をも業務内容としているとはいえ、もっぱら財産管理に力点が置かれているため、特に低所得者層を中心に移行が困難な状況にある。身上看護を中心とする成年後見人等の担い手が不足している現状において、社協の社会的役割から積極的な法人後見が求められる。しかしながら、社協が事業として実施するにあたり、受任対象範囲、マンパワー、利益相反、都道府県社協と市町村社協の役割分担等の多様な検討課題が浮き彫りとなった。18年度は、これらの課題に関して、岡山県社会福祉協議会の協力を得て、岡山県の状況をベースとする結論を得た。本研究で得られた成果をもとに、全国の社協の状況をつぶさに比較検討して、立法政策提言に発展させることを次のステップとしたい。2について岡山大学において職能団体の制約を受けない形で、弁護士、司法書士、医師、看護師、社会福祉士等が個人加入する専門家ネットワークを形成し、それによる権利擁護活動の実践に至ることができた。特に、専門家ネットワークを基盤に「医療・福祉リーガルリスク予防研究センター」を設置し、大学主体の中間組織の立ち上げを行った。10月には「医療・福祉におけるリーガルリスクの予防と解決の将来像-専門職の連携と協働-」と題するシンポジウムのシンポジウム司会を務め、医療関係トラブルをめぐる権利擁護のあり方について討議し、本研究推進の一助とするとともに、本研究での知見を生かした意見交換を行った。3について個人情報保護を素材に、社会福祉法人職員のコンプライアンスおよびリスクマネジメント活動と権利擁護の関係性を検討した。
