The Comparative Constitutional Study of the Social Exclusion and the Social Inclusion

本研究的第一个目的是阐明社会排斥的现实。本研究的第二个目的是寻求一种克服社会排斥的政策。因此，笔者采用比较宪法学和临床法律的研究方法，对日本社会排斥的特点进行了分析。一些失业者被排除在社会保障之外，失去了房子。无家可归的人被剥夺了一项应有的权利，失去了他的公民身份。他们每天都受到监视和驱逐。他们被关押在教养所。日本和美国有着完全不同的就业制度和社会保障制度，但却存在着同样的社会排斥问题。但是，日本有日常生活援助制度。在日本，日常生活援助制度成为克服社会排斥的关键。但现在生活辅助系统出故障了。由于其他安全网不能充分发挥作用，所有负担都取决于系统。我们必须消除这些负担，以恢复日常生活援助制度的功能。

The first purpose of this study is to elucidate reality of the social exclusion. And the second purpose of this study is to pursue a policy to overcome social exclusion. Therefore I use a method of a comparative constitutional study and a clinical legal study.The characteristics of the social exclusion in Japan are in the next points. Some unemployed people are excluded from social security and loses a house. Homeless people are deprived of a right to have rights, lose his status of the citizen. And they are kept under daily surveillance and evictions. They are taken in correctional facilities. They do not have the house which returns after having left the prison.Then, they have no place to live on the earth.Japan and U.S.A. have a totally different employment system and social security system, but have the same problem of social exclusion. However, Japan has the Daily Life Assistance system. It is the Daily Life Assistance system to become the key overcoming social exclusion in Japan. But the Daily Life Assistance system is malfunctioning now. Because other safety nets do not function enough, all burdens depend on the system. We must remove these burdens to restore the function of the Daily Life Assistance system.
