Analyzing MSS of a decretal letter of 1177, by which a glossator Magister Vacarius was appointed as a papal judge delegate, made clear that this letter meant the turning point in the history of the canon law about the formation of marriage from consensusto consensus andconcubitus. This seems to be an application of the canon law of marriage to an English case, however, we should rather see here the canon law being formed as a result of concrete lawsuits.

通过对1177年一封任命一位注释学家瓦卡里斯（MagisterVacarius）为教皇法官代表的敕令信的分析，可以清楚地看出，这封敕令信是教会法历史上婚姻形成从合意到合意再到纳妾的转折点。这似乎是教会法的婚姻适用于英国的情况下，然而，我们应该看到在这里教会法正在形成的具体诉讼的结果。
