Reconstruction of child support in Japan

在日本，领取子女抚养费的监护父母数量非常少。离婚的父母不一定要安排子女抚养费，也可以在没有法院命令的情况下离婚。日本的家庭法没有定义孩子的最大利益，也没有为离婚的孩子制定政策。因此，没有具体的子女抚养制度，行政机关和家事法院很难介入家庭。美国制定了一项子女抚养执行计划，由州政府机构找到无监护权的父母，向他们收取子女抚养费，并将款项支付给监护权的父母。当无监护权的父母不支付全部金额或根本不支付时，就需要采取强制行动。在美国，家庭问题被视为国家问题。根据联邦儿童抚养办公室的说法，他们的愿景是孩子们可以依靠父母的支持和爱，他们需要健康和成功。这样的观念和制度对日本家庭法对待家庭的态度的转变有很大的帮助。

In Japan, the number of custodial parents taking child support is very less. Divorcing parents do not necessarily make an arrangement for child support and can divorce without court order. Japanese family law does not define the best interests of the child and does not make a policy for the divorced child. As a result, there is no specific child support system, and it is difficult for the administration and family court to intrude into the family. The United States has made a child support enforcement program in which the state agency locates noncustodial parents, collects the child support from them, and pays out the payment to the custodial parents. When noncustodial parent does not pay the whole amount or does not pay at all, enforcement action is required. In the United States, family issues are treated as national issues. According to the federal office of child support, their vision is that children can count on their parents for the support and love they need to be healthy and successful. Such a concept and system are very helpful to transform Japanese family law’s attitude toward to the family.
