项目摘要

本年度は、（１）史料収集とその事実関係の整理、（２）論文の執筆、（３）学会での研究報告を主に行った。（１）史料収集・整理。上海図書館では日本に入手できない史料を閲覧・収集した。（２）論文執筆。a. 清朝渉外事件についての研究をすすめ、関連資料を補足し、裁判管轄権をめぐる清朝、ロシア、朝鮮の三者間の紛争がどのように解決されたのかに中心として、この両国の法規範が浸透或いは対立しつつ並存する多元的な秩序で成り立たれた空間において、裁判実態を明らかにした。b. 一年目に集めた各地の文献を更に深く検討し、八旗の土地制度を明らかにし、裁判事例から漢人と八旗との土地紛争の要因を探求し、当時の土地秩序を解明し、清朝全体における東北地方の財産制度の特徴及び位置づけについて論じた。c. 八旗と民人を扱う刑事司法の変容に注目した。司法上八旗・民人の区別に対して、司法過程と覆審制度における中国内地と辺彊との差異に重点を置いて、清朝がどのような態度をとっていたかについて研究を行った。d. インド・アフリカなどの旧植民地研究から発足した法多元主義に対して、本研究が今まで応用された清朝の事例を出発点として、法多元主義という理論自体を再検討した。（３）研究報告。中国長春で開催された中国法制史研究大会において、私は「帝国・辺境・法：清露渉外事件の裁判管轄紛争を中心として」と題した口頭報告を行った。中国法制史研究会は４０年の歴史と２００人の会員を持つ大規模な学会である。私の報告に対して様々な有益なコメントをいただいた。

This year, we will focus on (1) the collection of historical materials and the arrangement of practical relations,(2) the writing of papers, and (3) the research reports of the society. (1) Collection and arrangement of historical data. Shanghai Library started reading and collecting historical materials from Japan. (2) Writing papers. a. The dispute between Qing Dynasty, Russia and Korea should be resolved by the center of the dispute, and the legal norms of the country should be permeated or established by the coexistence of the multidimensional order, which should be established in space and judged clearly. b. A year-long collection of documents from all over the country, a deeper discussion, a clear understanding of the land system of the eight banners, a case of judgment, an exploration of the main causes of the land disputes between the Han nationality and the eight banners, an explanation of the land order at that time, a discussion of the characteristics and positions of the property system of the northeast region in the Qing Dynasty as a whole. c. Eight Flags and People's Court Judicial Eight Banners, People's Distinction, Judicial Process and Review System in China Mainland, Strong and Strong Differences in Focus, Qing Dynasty, Different Attitudes, etc. d. The study of the ancient Chinese culture and the development of legal pluralism is a re-examination of the theory itself. (3) Research reports. Changchun, China, opened the China Legal History Research Conference, and the topic of "Empire, Border and Law: Clearing the Center of Jurisdiction Disputes over External Events" was presented orally. China Legal History Research Association has a history of 40 years and 200 members. It is a large-scale society. Private reports are included in the list of helpful information.
