Study on copyright Law System corresponding to development of multimedia.

这项研究的目的是考虑在多媒体技术发展和其他版权作品的数字化利用所导致的环境变化中，版权制度在不久的将来的形态。在作品、表演、录音制品方面，我们面临着通过数字传输或通过DYD、闪存等方式进行的新型开发，同时也面临着新媒体之间的接口问题，例如广播的数字化和数字传输之间的问题。目前，随着音乐传播、电子出版、数字广播等数字化开发的范围不断扩大，寻找一种与技术手段接口紧密的新的版权保护体系已成为我们的当务之急。在这方面，我们已经能够考虑与WIPO版权条约和WIPO 1996年12月的表演和录音制品条约相对应的国际、国外和国家的发展，因此，我们可以清楚地认识到建立一个以加密、水印等技术手段为支撑的权利管理系统的可能性。它是与电子商务、电子认证、电子支付等系统相结合的电子版权管理系统。在这里，我们似乎有可能谈论“电子”行使版权，“电子”授权作品利用。

This study aims to consider a near future's figure of copyright system in the changing environment led by technological developments for multimedia and other digital exploitations of copyrighted works.In respect of works, performances, phonograms, we are facing new types of exploitation through digital transmission or with DYD, flash-memory etc. and simultaneously new issues on interface between old and new media, for example, between digitization of broadcasting and digital transmission. Now, while the scope of digital exploitation such as music transmission, electronic publishing, digital broadcasting is expanding, it has been our urgent task to find out a new copyright protection system with a tight interface with technical means. In this respect, we have been in a position to consider international, foreign and national developments corresponding to WIPO Copyright Treaty and WIPO Performances and Phonograms Treaty of December 1996.Consequently we could clearly recognize a possibility to establish a right management system supported by technical means of encryption, watermarking and so on. It is "Electronic Copyright Management System" combined with other systems such as electronic commerce, electronic certification, electronic payment. There it seems possible for us to talk about "electronic" exercise of copyright, "electronic" authorization of work exploitation.
