项目摘要

適格消費者団体の差止請求権行使の実務について、消費者庁のウェブサイトにて公表されている適格消費者団体の資料、適格消費者団体のそれぞれのウェブサイトにて公表されている活動記録を収集分析するとともに、消費者支援ネット北海道、消費者支援機構関西、消費者ネット広島の関係者に対するヒアリングと申入れ等の記録に基づく統計的な分析作業を行った。すでに最初の適格消費者団体の認定が平成19年（2007年）であり、消費者庁のウェブサイトにおける公表資料の公開期限（現時点で2019年）はもちろん、各団体の公表期限（団体ごとに異なるが、5年程度というところが多い）も経過しているものが多く、各団体からの情報提供によらざるを得ない部分が大きいので、調査は難航している。しかしながら、このことは逆に本研究の意義・重要性を限りなく高めるものということができる。他方で、訴訟になった事例については、一般に公開された判決文のみならず、各団体がそれぞれのウェブサイトで公開している判決文や和解条項を収集し、これを元にして各団体からの情報提供で申入れ段階の交渉経緯と、訴え提起に至った事情、訴訟中の主張の経過や変遷などを整理して、判決で差止めが認められたり棄却されたり、あるいは和解による解決に到達した経過から、それぞれの結論に至った要因分析を行っている。本研究が差止請求権行使の正統性を検討するというものであり、訴訟事案においても訴え提起に至った経過から訴訟前の交渉では決着が着けられなかった要因を明らかにすることで、訴訟提起の正統性の有無が基礎づけられるし、また訴訟中の主張の変遷からも、その判決や和解という決着の当否や内容面での必然性を明らかにすることができる。2022年度はまだ調査分析が完了しておらず、上記のような検討のために引き続き調査分析を進めていく。なお、フランスの消費者団体実務との比較は一定の進展を見た。
