项目摘要

1今年度は昨年度の研究成果をふまえ、理論的研究を中心に遂行し、あわせてそれを補強するために全国550余の自治体首長にアンケート調査を行った。第3セクターの運営やそれに対する統制、行政的評価の実態については、設立の理由は第3セクターの事業目的によって様々であること、経済社会状況の変化を反映して第3セクター形態による事業展開の分野がハードを中心とするものからソフト面を中心とするものへと変化しつつあること、第3セクターの事業活動に対する評価は当該事業分野の性格によって様々であり一様には語れないこと、第3セクターに対する様々な統制一議会や首長部局による監視・監督等ははなはだ不十分な状態にあること、その他多くの新しい知見を得ることができた。第3セクターに対する法学的行政学的研究を通じて、従来の「行政主体論」的理論枠組にかわる新しい認識枠組を設定する必要性が確認され、また、従来の行政処分や行政指導を念頭に置いた「権利救済」を中心とする伝統的な行政統制手法は、第3セクターに対する統制論としては極めて不十分であり、立法論を視野にいれた枠組形成の努力が必要であること、また、現実的な統制としては、現行制度においては議会を通した統制が有効であり、それを活性化するために必要な方策が研究された。経済学的研究を通じて、第3セクターの政策効果を経済学的に解明する場合は、官民の出資比率が重要であること、その他の多くの新しい知見が得られた。
