本研究は、大規模質問紙調査、質的調査、各種二次資料を用いて、国民の紛争処理に関わる弁護士・司法書士の利用パターンの客観的把握と、制度変容の影響を実証的に明らかにするものである。具体的には、なお、全体として我が国における法律家利用の低調さが見られるものの、法曹人口増員、司法書士法改正など司法制度改革の影響下で、クレジット・サラ金事件など簡裁事件での活用の増加など新たな動きの出現と、さらにその法改正に連動した動きが発見され、法制度の変容と法曹利用の短期的連動現象が明らかとなった。
