司法省機構の法制面での比較史的検討に関して,計画に照らして以下の結果を獲得できた。(1)司法省導入期(明治前期)の制度立案関係資料,明治前期に参考にしたと推定される19世紀フランス裁判制度関係図書の収集を国立公文書館,国会図書館,および同憲政資料室などにおいて収集し,近年の19世紀フランスの裁判官および司法省機構関係研究文献を収集することができた。(2)こうした資料を現在検討中であるが,日仏の近代国家成立期の裁判官集団近代化過程について次の点が明らかになってきた。19世紀フランスについては,司法大臣=司法省は,アンシャンレジーム期に高等法院との対抗関係で国王の立場を代表した大法官の制度を基礎にして創出され,これに裁判官監督と人事権を掌握させることによって,司法省を基軸にした裁判官集団の再編成=統括方式(司法大臣=司法省による裁判官監督と人事権の集中)が採用された。これによって,これまで政治権力から相対的に自立して存在していた裁判官集団を近代国家における司法権として再編成するという課題(議会制定法・法典に対する「恣意的」解釈抑制あるいは裁判官集団内部の人事の近代国家内への吸収など)が実現されていったと考えられる。まさにこの点に,新たな国家秩序,法秩序を全国に浸透させるために不可欠な担い手としての近代的な裁判官集団の形成を行わなければならなかった太政官政府にとって,上述の司法省を基軸とした裁判官再編成=統括方式の有用性と採用の必然性があった。裁判官集団の再編成がいちおう完了した20世紀段階固有の課題として発生してくる裁判官の官僚制化という課題という従来の観点からではなく,むしろ近代国家成立時の司法権の再編成という19世紀固有の課題という観点から,日本の司法省制度を新たに位置づけ直す展望を獲得することができた(明治前期の段階について得られた成果を発表すべく準備中である)。
