本研究は、生物遺伝資源および伝統的知識に関わるガバナンスを確立するための要件を探ることを目的としている。それに基づいて、今年度は、伝統的知識の登録に関する国際比較研究、商業機密と伝統的知識、伝統的知識の所有権と他の権利との関連を中心に検討した。特に、2003年12月にパプアニューギニアおよび2004年2月にマレーシアにおいて現地調査および生物多様性条約締約国会議に参加し、遺伝資源と伝統的知識に関する最新動向を把握し、関連資料の入手に努めた。また、日本における伝統的知識の保全については、2003年5月および9月に、仙台、滋賀および京都において藍染め技法の継承者を訪ねてヒアリング調査を行い、関連資料を入手した。それらの資料に基づき、さらに、この分野の研究者に聞き取り調査を行うとともに、関連研究会合に出席し、論議を深めた。それには、本研究の経費以外により参加した関連会議も含まれる。たとえば、2003年9月に国連大学において開催された生物遺伝資源に関する国際会議に研究代表者および研究分担者ともに出席し、報告し論議に参加した。2003年10月にマレーシアで開かれたWTOに関する研修プログラムに、研究分担者は参加を要請され、「貿易、生物多様性および伝統的知識」について報告を行った。2004年1月には、ベトナムで開かれた「バイオテクノロジー、貿易および持続可能な開発に関するワークショップ」に、研究分担者は国連大学より参加を要請され、生物遺伝資源と伝統的知識について報告を行った。研究代表者および分担者は、それぞれ、それらの場を通じて人的ネットワークを広げるとともに、法的観点からの論議を行った。他方、伝統的知識については、研究代表者との論議も踏まえて、研究分担者は、その後も研究を続け、国連大学高等研究所の政策報告書シリーズの中の一冊として、「伝統的知識の保護において登録制度の果たす役割」(報告書は英文)というテーマの論文が2004年1月に出版された。また、主要環境条約および主要国際機関によって運営されているミレニアム・エコシステム・アセスメントのうち、生物多様性に関する主要対策のセクションについて協力を要請され、研究代表者と研究分担者との共同作業によって報告書原案を提出し、国際編集委員会との調整に基づき、随時改訂作業を続けている。

This study aims to explore the relationship between biological heritage resources and traditional knowledge.
