项目摘要

本年度はまず,昨年度の現地調査により,新潟弁護士会所属,坂東克彦氏による一次資料の所蔵が判明したので,坂東資料の保存,整理,分類を行った。しかし,10万ページを越えると思われる一次資料について,そのすべてを整理・分類したうえで,水俣病事件全体の評価を行うまでには至らず,むしろ,その一部に着手し得たに過ぎない。本年度の成果としては,坂東資料の所在が明らかとなり,その保存,公開機関として,新潟県立「環境と人間のふれあい館」の協力を得るに至った点に存するといえよう。坂東資料を活用し,さらに水俣病事件の全貌を明らかにするために,他の文献資料との比較照合を行うことは,今後の課題としなければならない。本年度にまとめた成果の発表として,環境法政策学会,第10回学術大会分科会において,口頭発表を行った。この発表,およびこれに続く質疑応答を踏まえた補論は,次年度発行予定の学会誌に掲載される予定である。さらに,水俣病事件に関する訴訟事件史および理論的見地からの成果として,論文をまとめ,共著の一編として公表を予定している。具体的な研究の結果としては,水俣病という公害事件の解決に当たり,裁判という手段を活用することな,事件の公正な解決という一定の役割を果たしたものの,当事者の意識,個別具体的な裁判手続による救済対象者数の限定,時間の経過による機会費用の発生などの点で限界もあり,これを補うために期待された行政的救済枠組みについても,行政,政治部門の消極的姿勢により,事件解決機能を果たしえなかった,といった諸点を解明したことを挙げることができる。
